Introduction

This website is owned by Tender Tiger Private Limited (“TTPL”), which provides information about tenders floated by government organizations from across the world. Tender Tiger is an AI-driven tender platform.

TTPL acts as a third party providing a platform for information about tenders floated by various governments and is not particularly interested in the item(s) being sold or bought by or on behalf of the seller/buyer.

By using or accessing this website, you agree and acknowledge that you have read and understood these Terms of Use (“Agreement”), accept them, and agree to be bound by them.

General Terms and Conditions

The terms “You” and “User” as used herein refer to all individuals and/or entities accessing this site for any reason. “User Identity Code” means the code(s) allocated to the customer by the Company for the purpose of accessing the service. “Material” means text, graphics, images and any other viewable item or contents of the Service on this website.

All materials on this website are protected by copyright under applicable Indian laws. Unauthorized use of the Material may violate copyright, trademark, intellectual property or other applicable laws.

This Agreement is governed and construed in accordance with the laws of the Union of India. Users hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Gujarat, India for disputes arising out of or relating to use of the website, subject to any mandatory rights that may apply under applicable law.

How to Exercise Your GDPR Rights?

To exercise a GDPR right, or to submit a privacy/data protection request, contact TTPL at Care@TenderTiger.com. Please clearly identify the right you wish to exercise and provide sufficient information for TTPL to understand and verify your request.

TTPL may take reasonable steps to verify the identity of the requester before providing Personal Data or acting on a request, particularly where the request involves sensitive account or personal information.

TTPL will generally respond to a valid GDPR rights request without undue delay and, in any event, within one month of receiving the request. Where permitted by the GDPR, this period may be extended by up to two further months where necessary due to the complexity or number of requests. If an extension is required, TTPL will inform the requester within the applicable initial period and explain the reason for the delay.

In respect of Subscription Services, TTPL will ensure that changes do not materially decrease or affect the functionality of those services. In respect of non-subscription services, TTPL may change or make additions, deletions, alterations or modifications to this Agreement as a result of its policy of updating and improving the Site or for security, legal or regulatory reasons. TTPL shall notify users of such activity where required.

If after such notification you do not agree to be bound by the changes, you may choose not to use the Site. Such changes will not affect any contract relating to ongoing Subscription Services that you have with the Company, except as otherwise permitted by applicable law and contract.

Disclaimer

TTPL runs its business on and through this as well as several other websites. TTPL uses outsourced server space from third-party hosting providers and shall seek to ensure the smooth running of its services in good faith. However, TTPL will not be held responsible for failure of power, network, server, hosting server, internet connectivity, ISP or otherwise at the seller’s/bidder’s end directly or indirectly affecting online bidding.

TTPL takes no responsibility for the quality, quantity or documentation details of tenders floated. To the extent permitted by applicable law, TTPL will not be liable for losses, damages, costs or expenses arising from transactions or interactions between sellers, buyers and bidders.

TTPL is only a service provider and is not a party to, and cannot control, transactions between seller/buyer and bidder.

This site and all information, content, materials, products (including software) and services included on or otherwise made available through this site are provided on an “as is” and “as available” basis, unless otherwise specified in writing.

You expressly agree that your use of this site, its contents and services is your responsibility and at your sole risk.

To the extent permitted by applicable law, TTPL will not be liable for damages arising from use of this site or its information, content, materials, products or services, including direct, indirect, incidental, punitive and consequential damages, unless otherwise specified in writing.

Breach of Statutes

Representations and Warranties

Rights

  • TTPL reserves the right to terminate this Agreement and the service to the User.

In the event of a breach by the User of these Terms and Conditions, TTPL reserves the right to terminate the User’s access to the Service and claim damages arising from the breach, if any, subject to applicable law.

TTPL reserves the right to amend these terms and conditions and announce amendments on the website. Accessing the website and/or using the services after an amendment may constitute acceptance of the amended terms, subject to any notice or consent requirements imposed by applicable law.

License and Ownership

License – Subject to the terms and conditions of this Agreement or Terms of Use, and until termination thereof, TTPL grants you a non-exclusive, non-transferable and limited license to view, print and reproduce content on this site without alterations, for personal, non-commercial use only.

Ownership – TTPL exclusively owns the contents of this site, and such content or any part of the site is strictly protected. Use of the materials on any other website or in a networked computer environment for any purpose is prohibited without permission. You shall not copy or adapt HTML code created by the Company to generate its pages. Such code is also protected by the Company’s copyright.

This Agreement shall continue in full force and effect for so long as you are using the services and website.

Governing Law and Jurisdiction

These Terms of Use and your use of the Services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

The courts at Ahmedabad, Gujarat, India shall have exclusive jurisdiction over any dispute, claim, controversy or proceeding arising out of or in connection with these Terms of Use, the Services, or your use of the Services.

Nothing in this clause shall be construed as limiting or excluding any mandatory statutory rights, remedies or jurisdiction that cannot lawfully be waived or excluded under applicable law.
